When one buys property with all the legal documents stating they have title and right of way (which has existed for at least 40 years anyway), one wouldn't think there would be any legal disputes. And if something happens, the law takes precedence, doesn't it?
It doesn't seem to be happening in this case. The American couple woke up one morning to find they had been barricaded inside their property. A gate had been locked and a 20 ft wide by 6 ft deep trench had been dug across the easement, preventing any vehicular access.
On August 14th, the community gathered to assist the couple in refilling the trench and providing them with the basic access to their home. They had acquired the judgement from the authorities, to remove any barricades and allow full access. Neighbors came with shovels and banners. And a backhoe was graciously donated to fill and pack the trench. The easement was opened up to the prescribed legal width by 1 pm.
Unfortunately, the company who holds the easement is Citricos S.A. This company is run by a Columbian citizen who holds no regard for the law, here in Panama, nor does he hold any respect for the Panamanian citizens who live here.
Citricos retaliated only a few hours later by digging not one trench across the easement.....but three ! They dug one at the entrace to the main road, half way down and at the entrance to the couple's property. This makes it completely impossible for one of them to leave the property and he has already had to cancel urgent surgery as he was unable to drive off the property.
The situation is becoming international news and unless Martinelli or his government get involved to re-enforce laws, Panama will no longer be a desireable retirement destination.
